General Terms and Conditions (GTC)
1. Scope of Application & Margin Taxation
These Terms and Conditions apply to all orders placed through our online shop. Our online shop is intended exclusively for consumers.
For the sale of new goods, in particular Vantrue dashcams and accessories, sales are made with VAT shown separately where required by law.
For the sale of used goods, in particular used car radios and navigation devices, margin taxation pursuant to Section 25a of the German VAT Act (UStG) may apply. In this case, VAT is not shown separately.
2. Contracting Party, Conclusion of Contract
The purchase contract is concluded with: Radio Codes Gökhan Ince, sole proprietorship.
The presentation of products in the online shop does not constitute a legally binding offer. By clicking the order button, you submit a binding offer. The contract is concluded by our declaration of acceptance in a separate e-mail, by our request for payment, or by the performance of the service, namely dispatch of the goods or transmission of the code.
3. Contract Language, Storage of Contract Text
Available languages: German, English, French, Dutch, Spanish, Italian, Polish.
We store the contract text and send you the order details and our Terms and Conditions in text form.
4. Customer’s Duties to Cooperate
For the determination of radio codes and for repairs, the transmission of correct data, for example serial numbers, or image files is required.
The customer is solely responsible for the accuracy of the data provided. In the event of incorrect information provided by the customer that leads to an incorrect code, there is no entitlement to free rectification or reimbursement, provided that the service was performed in accordance with the customer’s information.
5. Delivery Conditions
Shipping costs: In addition to the stated prices, shipping costs of EUR 5.99 apply for physical standard shipping. Digital content, such as radio codes, is delivered free of shipping costs by e-mail.
Collection: Collection from Radio Codes Ince, Brüder-Grimm-Str. 23, 63584 Gründau, Germany, is possible by prior appointment. We do not deliver to parcel stations.
6. Payment & Retention of Title
Prices: The total prices valid at the time of the order apply.
Payment methods: Advance payment, cash payment upon collection, credit card, PayPal including Express/Checkout, Apple Pay, Google Pay, Klarna, iDEAL and Alipay. Payment processing is carried out via Wix Payments or Stripe.
Retention of title: The delivered goods remain our property until full payment has been made.
7. Warranty & Liability
The statutory liability for defects applies.
For new goods, in particular new Vantrue dashcams and new accessories, the statutory rights concerning liability for defects apply.
For used goods, in particular used car radios and navigation devices, the limitation period for claims for defects against consumers is one year from delivery of the goods.
For digital products, the statutory provisions for digital products, Sections 327 et seq. of the German Civil Code (BGB), apply.
Any additional warranty granted by the manufacturer, for example a Vantrue manufacturer’s warranty, exists in addition to the statutory rights concerning liability for defects and does not restrict them.
Our liability for damage resulting from injury to life, body or health, as well as for damage based on intent or gross negligence, remains unlimited. In the event of a breach of essential contractual obligations, liability is limited to the foreseeable damage typical for this type of contract. In all other respects, liability is excluded to the extent permitted by law.
In the case of repairs, we are not liable for the loss of stored device data. If a device is irreparable, we will inform the customer; any return shipping costs already incurred shall be borne by the customer in this case.
Notice Regarding Manufacturer’s Warranty
For certain Vantrue products, a voluntary manufacturer’s warranty from Vantrue may apply. This warranty is granted by the manufacturer and exists in addition to the statutory rights concerning liability for defects. Your statutory rights against us as the seller are not restricted by this.
8. Special Notices Regarding Withdrawal & Voluntary Guarantee
8.1 Digital Content, Codes
The right of withdrawal expires prematurely if we have begun performance of the contract after you have expressly agreed that we may begin performance before the expiry of the withdrawal period and you have confirmed your knowledge that you will lose your right of withdrawal as a result.
8.2 Services
In the case of repairs, the right of withdrawal expires upon complete performance of the service, provided that you have previously given your consent to the start of performance and confirmed your knowledge that the right of withdrawal will expire.
8.3 Voluntary Money-Back Guarantee for Radio Codes
In addition to the statutory right of withdrawal, we grant a voluntary money-back guarantee for digital radio codes under the following conditions:
Period: The guarantee can be claimed within 20 days from the date of purchase.
Requirement: The guarantee applies exclusively in the event that the delivered code does not work despite correct data entry by the customer.
Proof: To claim the guarantee, a proof video must be submitted in which the entry of the delivered code on the device and the error message are clearly visible.
Exclusion: The guarantee does not apply in the event of incorrect transmission of serial data by the customer or in the event of mechanical or electronic defects of the radio that prevent code entry.
9. Dispute Resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
10. Final Provisions
Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. Severability clause.
