General Terms and Conditions (GTC)
1. Scope & Differential Taxation
The following terms and conditions apply to all orders placed via our online shop. Our online shop is aimed exclusively at consumers. For the sale of used radios, differential taxation applies in accordance with § 25a UStG (German Value Added Tax Act); therefore, sales tax is not shown separately.
2. Contractual partner, conclusion of contract
The purchase contract is concluded with: Radio Codes Gökhan Ince Sole Proprietorship.
The presentation of products in the online shop does not constitute a legally binding offer. By clicking on the order button, you are submitting a binding offer. The contract is concluded by our declaration of acceptance in a separate email, by the request for payment, or by the performance of the service (shipment of the goods/transmission of the code).
3. Contract language, contract text storage
Available languages: German, English, French, Dutch, Spanish, Italian, Polish. We store the contract text and send you the order data and our terms and conditions in text form.
4. Customer's obligations to cooperate
The transmission of correct data (e.g., serial numbers) or image files is necessary for the determination of radio codes and repairs. The customer bears sole responsibility for the accuracy of the data transmitted. In the event of incorrect information provided by the customer, which leads to an incorrect code
5. Delivery terms
Shipping costs: In addition to the prices quoted, standard physical shipping costs €5.99. Digital content (radio codes) is delivered free of charge by email.
Pickup: Pickup at Radio Codes Ince, Brüder-Grimm-Str. 23, 63584 Gründau, Germany, is possible by prior appointment. We do not deliver to packing stations.
6. Payment & Retention of Title
Prices: The total prices at the time of ordering apply.
Payment methods: Prepayment, cash on pickup, credit card, PayPal (including Express/Checkout), Apple Pay, Google Pay, Klarna, iDeal, and Alipay. Payments are processed via Wix Payments or Stripe.
Retention of title: The delivered goods remain our property until full payment has been received.
7. Warranty & Liability
General: The statutory liability for defects applies.
For digital products, the statutory provisions (§§ 327 ff. BGB) apply.
Used goods (sale): For consumers, the limitation period for
claims for defects in used goods is one year from delivery of the goods.
Limitation of liability: Our liability for damages resulting from injury to life, limb, or health, as well as for damages based on intent or gross negligence, remains unlimited. In the event of a breach of essential contractual obligations, liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability is excluded. In the case of repairs, we are not liable for the loss of stored device data. If a device is beyond repair, we will inform the customer; in this case, the customer shall bear any shipping costs already incurred for the return shipment.
8. Special notes (revocation & voluntary warranty)
8.1 Digital content (codes)
The right of revocation expires prematurely if we have begun to fulfill the contract after you have expressly agreed that we may begin execution before the expiry of the revocation period and you have confirmed your knowledge of the loss of the right of revocation.
8.2 Services
In the case of repairs, the right of withdrawal expires upon complete performance of the service, provided that you have confirmed your consent to the commencement and your knowledge of the expiry in advance.
8.3 Voluntary money-back guarantee for radio codes:
In addition to the statutory right of withdrawal, we offer a voluntary money-back guarantee for digital radio codes under the following conditions:
Period: The guarantee can be claimed within 20 days of the purchase date.
Prerequisite: The guarantee applies exclusively in the event that the delivered code does not work when the customer has entered the data correctly.
Proof: To claim the guarantee, a video must be submitted as proof, clearly showing the delivery of the code to the device and the error message.
Exclusion: The warranty does not apply in the event of incorrect transmission of the serial data by the customer or in the event of mechanical/electronic defects in the radio that prevent code entry.
9. Dispute resolution
We are not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
10. Final provisions
Should any provision of these General Terms and Conditions be invalid, the remaining provisions shall remain unaffected (severability clause).
